Legal Malpractice is
the broad term to describe a lawsuit against a lawyer
based upon an allegation that the lawyer negligently
performed legal services on behalf of a client. Some
of the most common ways a lawyer might mishandle a case
are:
- missing a deadline
- not knowing the applicable law
- failing to properly advise a client about the details
of a settlement
- failing to diligently pursue a case
- prematurely settling or dismissing a case
- representing a client when there is a conflict of interest
Many
of these claims involve the inquiry into another person's
judgment, which can be a challenge if you are not experienced
in pursuing these types of cases. For a legal malpractice
case to be valid--the client must have suffered damages
(i.e. the client was harmed) as a result of the lawyer's
negligence. The direct connection between these two key elements
must be proven to obtain monetary compensation.
